Subject: Functional Independence and Administrative Strengthening of the Office of Chief Electoral Officer, West Bengal


The Election Commission of India has emphasized the need for enhancing the functional and administrative independence of the Chief Electoral Officer (CEO), West Bengal. The Commission refers to the notification dated March 28, 2025, under Section 13A of the Representation of the People Act, 1950, appointing Shri Manoj Kumar Agarwal, IAS, as the CEO of West Bengal.


Subsequent government notifications have confirmed his appointment and designated him as ex-officio Additional Chief Secretary, Home and Hill Affairs (Election) Department, Government of West Bengal.


However, the Commission has expressed concern over the current lack of financial and administrative autonomy available to the CEO. At present, the CEO’s office functions with limited financial powers, relying on minor advances from the Finance Department. Moreover, the CEO’s office is categorized as a subordinate branch under the Home and Hill Affairs Department, which is headed by a Principal Secretary, despite the CEO being of Additional Chief Secretary (ACS) rank.


Directions from the Election Commission:


To ensure institutional autonomy and effective election management, the following actions have been directed:


1. Creation of an Independent Election Department

A separate Election Department must be established, fully independent of other State Government departments. This department should have a dedicated budget head to enable complete financial and administrative autonomy for the CEO

2. Delegation of Financial Powers

The CEO, West Bengal, should be granted financial powers equivalent to those of ACS/Principal Secretary/Secretary-level officers. Additionally, a separate Financial Advisor must be appointed within the Election Department to assist in the efficient discharge of official responsibilities.

3. Staffing of Vacant CEO Positions

In preparation for the upcoming General Election to the Legislative Assembly of West Bengal, the State Government is requested to fill the four vacant posts of Additional/Joint/Deputy CEOs in consultation with the Election Commission to ensure institutional readiness and smooth coordination.
