CASUAL LEAVE for West Bengal PRIMARY SCHOOL Teacher

Primary & High School teachers get different types of leave during their Service life.  The Government has its own circular according to the Department about all those leaves.  As such, the School Education Department (Elementary and Secondary Branch) has a specific memorandum on all leaves, where the Rules & Regulations of all leaves are mentioned.  School Education Department Primary Branch Leave Notification Memo Number is 453-SE(Pry.), Dated- 04/05/1999 and Secondary Branch Leave Notification Memo Number is 1541-Edn(S)/21-2/77, Dated-  15/12/1977 and here the Leave Rules of Non-teaching Staff are also mentioned.


Attention

One thing to remember is that any type of leave is not the right of employees.  

(Leave cannot be claimed as right and the sanctioning authority reserves the right to refuse or revoke leave of any description, if, in the opinion of the authority, the exigencies of the circumstances demand, Memo No.  453-SE(Pry.), dated- 04.05.1999 as per clause (iii) of 8.)


Sanctioning authority for casual leave

In the case of primary teachers, the sanctioning authority for casual leave is the Sub-inspector of Schools -  According to clause (i) of 7 of the Notification.

But the person who takes it should apply first by writing to the HOI through proper channels and the HOI will be forwarded the Application to the Concerned S.I./s and if the HOI himself/herself takes casual leave, he/she is asked to apply through the Existing Committee - As per clause-ii of 7 of Notification.  However, there are no charge handover related guidelines if HOI casual leave is taken.


Other leave with Casual Leave

No other leave can be taken along with Casual Leave i.e. if you take Casual Leave you have to join the school, then you can take another leave.


 Any kind of leave except casual leave and compensatory leave, may be granted in combination with or in continuation of any other kind of leave, subject to such limits, as stated- As per  As per clause (ii) of 8 of Notification. 


Casual Leave in an academic year

Casual Leave is available maximum 14 in a Academic Year (January to December) with full pay.

If a teacher does not take this leave in one calendar year, then this leave is not accumulated in the next calendar year, 14 leaves will start again in the next year.

Attention

However, if an employee joins in the middle of the calendar year, the notification does not say anything about the number of casual leaves, in this case the decision of the leave sanctioning authority will be final.



Casual Leave at one time

However, a maximum of 7 days can be taken at one time with Holiday / Sunday except in very exceptional situations. But in case of an exceptional situation, it should be recorded in the service book. As per 4 of clause (a) of Notification. 


If you take casual leave, you have to join the school on the 8th day, if you can't join then you have to take another leave. In that case, medical leave should be taken because apart from casual leave only medical leave without permission can be taken, then sanction can be done with a medical fitness certificate.


Calculate casual leave (CL)

If a teacher joins the school on the 8th day after being absent from school for a total of 7 days (Including Sunday and Government Holiday), then only the Working Days of his absent days will be counted as CL.


How to take Casual Leave?

Suppose a teacher is on duty at school on Saturday and takes CL from Monday, while Sunday and Wednesday are Government Holidays.  If he joins the school on Thursday, then his holiday number will be 4 days, but casual leave will be 2 days (because we know, in case of CL, if you join on 8 days, CL will be counted excluding Sundays and Holidays).


 And, if a teacher takes a leave from Monday to next Monday after doing School Duty on Saturday, then counting the number of holidays here is more than 7 days, then CL will not be available in this case (even if there is a Sunday and Wednesday Government Holiday between those days).


Provided that Sundays and / or holidays preceding, following or intervening any period of casual leave shall not be counted as part of such leave - clause (a) of 4 of the Notification.


Application for  Casual Leave(CL) 

Any type of leave except Casual Leave(CL) and Medical leave is not granted without written application and if there is previous approval by the competent authority then it should be explained in writing to the satisfaction of the Leave Sanctioning Authority except for exceptional circumstances. In case of application for casual leave where prior approval has not been received but you have taken leave, submit your application as soon as possible and before resuming duty. As per,Clause (i) of 8 of the Notification.


Casual Leave with Summer and Puja Vacation

A teacher has taken leave on the day before the start of Summer or Puja Vacation in the school.  And he joined on the opening day of the school, in this case the number of days of absence of that teacher is more than 7 days with Vacation.


And a teacher has done duty in the school on the day before the start of Summer or Puja Vacation, but if he does not join the school on the day the school opens, in this case also the number of days of absence of the teacher due to vacation is more than 7 days, so in both cases there will be no casual leave sanction.

Attention

Sunday/Holiday is counted while taking leave of CL but if joining within 7 days only Working Days excluding Sunday/Holiday are counted as CL.
