Verdict of Arrears DA review petition

 A division bench of Calcutta High Court comprising Justice Harish Tandon and Justice Rabindranath Samant had last May ordered the state government employees to settle DA arrears within three months.  On May 20, the Calcutta High Court in a historic judgment said that DA is a fundamental right of government employees and the state government has to clear all the arrears DA (dearness allowance) of the Fifth Pay Commission within three months.  The deadline expired on August 19.  A week before the deadline, the state government filed a review petition on the High Court verdict.   After two consecutive days of hearing, Hon'ble Justice Harish Tandon and Justice Rabindranath Samanta stayed the verdict.  Finally, at 10.30 am on 22nd September, the verdict on the review petition of the state government was announced. Calculate the arrears of DA of West Bengal government employees and teachers

On 20th May, the Calcutta High Court directed the state government to settle the arrears of DA of West Bengal state government employees within 3 months. Now the difference between the DA of state employees and central government employees is 31%.  The Calcutta High Court has given a historic verdict in the DA case. State government employees have returned the smile on their faces. The High Court's decision in the original case was based on the Fifth Pay Commission. The more the central government raises the DA, the more the state government employees lag behind. As a result, the pay gap between central and state government employees has widened. The central government implemented the seventh pay commission from January 1, 2022. Now central government employees are getting 34% DA of their basic salary.
