Relief of teachers transferred away in teacher transfer case in Supreme Court. The court said that before the implementation of Section 10-C of the Teacher Recruitment Act in the state, those employed are not covered by transfer. During the hearing of this transfer case on Monday, the court asked the state why the working teachers were transferred 200 km away (Kolkata to Murshidabad)? The court observed, 'There are many women in this profession. So this is how we are thinking about the transfer.
The Supreme Court said as an interim order during the hearing , that the teachers who have been transferred to neighbouring areas can continue teaching. Rest of those transferred away can wait for further instructions. However, those who have joined the job after the introduction of Section 10-C, are not getting any relief for now.
The state has been directed to submit an affidavit within the next 4 weeks regarding the transfer of teachers in the Board of Secondary Education. The plaintiff teachers were given another two weeks to file their counter affidavit. The hearing was held in the Supreme Court bench of Justice Sanjay Kisan Kaul and Justice Sudhanshu Dhulia. The next hearing of this case is on December 15.
What is this section 10 C in the School Service Commission?
It is essentially an Act of Administrative Transfer. Those who have been serving under the commission since 1998, the commission can transfer them to the administrative field if required by the government. This law has been passed in the assembly. However, in some special cases, there are exemptions from this clause. Teachers can be excluded from this clause in case of blindness or other specific physical problems.
