Clarification regarding eligibility for appearing in TET exam

 


Those enrolled in the Teacher Training Course (TTC) are eligible to appear in the TET examination  There is no compulsion to appear in the final year or TET exam result. Any such student admitted to a teacher training course will be considered in the 'PURSUING' category. NCTE has issued a notification citing the order passed by the Supreme Court.



  Till now students were considered eligible to take the TET exam only when they reached the final semester / year. That rule is changing, though. From now on you can sit for the TET exam only after enrolling in the course.



  When this was litigated in the Supreme Court, the Supreme Court gave a broader interpretation to the term 'PURSUING'. NCTE issued this notification after this. Now students can take TET only after enrolling in teacher training course.



  Earlier, the Uttar Pradesh government in their TET exam notification said that those who are undergoing training can apply for the TET exam. But those candidates have to get or complete the training result within the TET exam result release, otherwise their TET certificate will not be valid. When the case was filed in the Allahabad High Court, the court ruled that the decision of the state was correct. When a petition was filed in the Supreme Court regarding this, the Supreme Court explained the word 'PURSUING' in detail and focused on the broad meaning of the word. The court upheld the plaintiffs' claim that anyone admitted to the training should be treated as a PURSUE, and could take TET exams.



  On the other hand, the Central Board of Secondary Education is going to release the notification for Central Teacher Eligibility Test CTET 2022 this week. With this the application process for CTET 2022 will start. Interested and eligible candidates can apply through CTET official website ctet.nic.in

Sir,

I am directed to refer to your letter No. DE.3(44)/DRC(E III)/TGT(Punjabi)/Female/2022/1051 dated 28.07.2022 on the subject cited above and to say that the Civil Appeal No. 5564 of 2019 (arising from SLP (C) No. 16698/2018 was disposed of by the Hon'ble Supreme Court of India vide order dated 16.07.2019. The operative para of the said order is as under: -


"Para 8.3.......as per dictionary meaning, the word "pursuing" means undergoing and/or proceeding further. Therefore, a candidate who has been admitted in any of the TTC and undergoing the teacher training course (TTC) can be said to be "pursuing" such teacher training course and shall be eligible to appear in the TET examination, Irrespective of the fact that whether, by the last date specified for filling up the online form for TET examination, he has, in fact, appeared in the examination of the concerned teacher training course and the result is awaited. "Pursuing" the requisite teacher training course is sufficient to make such a candidate eligible to appear in the TET examination. Therefore, on a fair reading of Clause 5(ii) of the NCTE guidelines, a person who has been admitted in TTC and is pursuing, he/she can appear in the TET examination"...


"Para 8.4..... Therefore, it is clear that the respective appellants herein whose appointments were challenged were eligible to appear in the TET examination at the time they were "pursuing" the concerned TTC. Thus, we hold that the decision of the High Court, to the aforesaid extent, is not sustainable. The impugned orders of the High Court are accordingly modified to the aforesaid extent...."

It is clear from the Order passed by the Hon'ble Supreme Court of India that a candidate who has been admitted in any of the TTC and undergoing the teacher training course (TTC) can be said to be "pursuing" such teacher training course and a fair reading of Clause 5(ii) of the NCTE guidelines, a person who has been admitted in TTC and is pursuing, he/she can appear in the TET examination.


3. In view of the above. it is clarified that a fair reading of Clause 5(ii) of the NCTE guidelines, a person who has been admitted in TTC and is pursuing. he/she are eligible for appearing in TET examination, if otherwise eligible, as per extant guidelines of TET circulated on 11.02.2011, as amended from time to time and Notifications laid down by NCTE regarding minimum qualifications, as amended from time to time.


4. This issue has the approval of the Competent Authority.
