Verdict of Arrears DA review petition

 A division bench of Calcutta High Court comprising Justice Harish Tandon and Justice Rabindranath Samant had last May ordered the state government employees to settle DA arrears within three months.  On May 20, the Calcutta High Court in a historic judgment said that DA is a fundamental right of government employees and the state government has to clear all the arrears DA (dearness allowance) of the Fifth Pay Commission within three months.  The deadline expired on August 19.

 A week before the deadline, the state government filed a review petition on the High Court verdict. 

 After two consecutive days of hearing, Hon'ble Justice Harish Tandon and Justice Rabindranath Samanta stayed the verdict.

 Finally, at 10.30 am on 22nd September, the verdict on the review petition of the state government was announced.

The review petition filed by the state in the DA case was dismissed.  A division bench of Justice Harish Tandon and Justice Rabindranath Samant upheld the 21st May order.
